The Team
This role sits in the Transport Asset Revitalisation Program (TARP) under the Commercial Services section within the Development Branch of the Infrastructure and Place (IP) division of TfNSW.
TARP business is a special purpose business which has been established to assess properties and lands, owned by either Transport for NSW (TfNSW) or Transport Asset Holding Entity (TAHE) (formerly known as RailCorp), which are no longer required as part of their core businesses. These properties and lands are typically adjacent to rail networks, existing roads/freeways or associated assets (e.g bridges, tunnels etc) and well located near services.
The TARP Team take steps (including working with a wide range of advisers) to make the properties and lands sale ready, followed by further steps to transact the sale of the properties and lands as part of creating an improved urban environment.
Commercial Services provides support, strategic advice and best practice management in the development, procurement and commercial management of the IP division’s many projects and programs. The team is agile in its approach to provide best for Transport outcomes and promote thought leadership to drive continuous improvement and professional development opportunities.
The Opportunity
The role is to ensure the commercial protection of the IP division and its portfolio of projects via its contractual management arrangements and dispute resolution strategies. The role will also require provision of advice on commercial matters, contract negotiations, contract risk allocation, probity, cost benchmarking and reporting and value for money measurement to support the achievement of best practice compliant contracts.

Responsibilities
As the Commercial Manager for a Program Role, you will report to the respective Director Commercial with responsibility for contract management, project development/delivery, commercial advice, financial management, internal governance matters and people management.
Key aspects of the role include:
Active participation in the development of the delivery strategy (including design, procurement and contracting strategy) and risk allocation to support contract development
Leading, advising and providing recommendations to project teams on contractual issues or claims (i.e. entitlement, relevant time bars, submission requirements, evaluating costs claimed etc.). Including drafting the appropriate correspondence to manage these matters effectively
Drafting complex and bespoke correspondence in relation to the Program’s contracts and third parties
Managing insurance claims based on internal procedures and principal’s insurance policies and support specialist advisors in providing advice to the Program on insurance matters.
Providing advice and input to Project Managers and Project Directors on the service providers’ cash flow and the project final forecast cost (input into regular reporting as required)
Chairing and leading Project & Commercial meetings (external and internal)
Managing the contractual correspondence between TfNSW and the other contractual parties on the Program.
About you
To be successful in this role you will have:
Commercial acumen gained from prior commercial management roles across a range of contract types (either from the private sector or similar government roles)
The ability to quickly and efficiently understand the issues which arise from delivering multiple projects simultaneously
Strong verbal/written communication and relationship management skills with the ability to work with a variety of stakeholders
Relevant tertiary qualification(s), which may include commerce, business, finance/analytics, engineering, construction management, project management or law
